LIGHTING TEXT ON PERSONAL DATA

 

Banu Aykın Köylüer is the founder of  As Banay Akademi (“Banay Akademi”), we care about the security of your personal data. In order to explain under what conditions and how your personal data is processed, we provide the clarification text regarding this personal data (“Clarification Text”) for your information.

 

Within the scope of the Law on the Protection of Personal Data No. 6698 (“KVKK”), we record your various data, which is considered as personal data, from time to time in electronic or physical environment as the data controller and process them in accordance with the law.

 

i) Our Personal Data Processing Principles

 

Your personal data is processed by Banay Akademi in the light of the following principles:

 

  1. Compliance with the law and the rules of honesty,

 

  1. Being accurate and up-to-date when necessary,

 

  1. Processing for specific, explicit and legitimate purposes,

 

  1. Being connected, limited and restrained with the purpose for which they are processed,

 

  1. To be kept for the period required by the relevant legislation or for the purpose for which they are processed.

 

ii) Liability of Illumination

 

Pursuant to article 10 of the KVKK, while obtaining the consent of the data subjects, the data controllers are obliged to inform and it is regulated that the data subjects should be informed. In this direction, Banay Academy, which has the title of data controller,

 

  1. Identity of the data controller and its representative, if any,

 

  1. For what purposes personal data are processed,

 

  1. To whom and for what purpose the processed personal data can be transferred,

 

  1. Methods and legal reasons for collecting personal data,

 

  1. The rights of the data subject to be directed to the data controller pursuant to article 11 of the KVKK

 

should be informed about it.

 

With this Clarification Text, as Banay Akademi, we inform you about the processing and protection of personal data in accordance with the provision of Article 10 of the KVKK.

 

iii) Identity of Data Controller

 

Article 3/1 (ı) of the KVKK defines the data controller as “the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system”. In accordance with this provision, Banu Aykın Köylüer has the title of "data controller". Banay Academy is an academy founded by Banu Aykın Köylüer.

iv) Processing and Purposes of Personal Data

 

As Banay Akademi, we only process your personal data with your explicit consent or in the presence of one or more of the following legal conditions. 

 

  1. clearly stipulated in the law,

 

  1. It is compulsory for the protection of the life or physical integrity of the person or another person, who is unable to express his consent due to actual impossibility or whose consent is not legally valid,

 

  1. Provided that it is directly related to the establishment or performance of a contract, it is necessary to process the personal data of the parties to the contract,

 

  1. It is mandatory for the data controller to fulfill its legal obligation,

 

  1. The person concerned has been made public by himself,

 

  1. Data processing is mandatory for the establishment, exercise or protection of a right,

 

  1. Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

In accordance with the above principles; your personal data Scientific research, survey, study, consultancy, training activities carried out by Banay Academy, mentoring  and for the purposes of providing coaching services and fulfilling legal obligations, to the extent and during the time period required by the relevant purposes.

 

Data related to race, ethnicity, political thought, philosophical belief, religion, sect or other belief, costume and dress, membership to associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, which are considered to be of special nature within the scope of article 6 of the KVKK. biometric and genetic data; can only be processed with explicit consent; Personal data other than health and sexual life may be processed without seeking the explicit consent of the person concerned, in cases stipulated by the laws.

 

v) To Whom and For What Purpose the Processed Personal Data Can Be Transferred

 

Your personal data processed by Banay Academy in accordance with the principles and provisions of the KVKK; It can only be transferred to our business partners, suppliers, Banay Academy officials, legally authorized public institutions and private individuals in line with the above-mentioned purposes, within the framework of the conditions specified in Articles 8 and 9 of the KVKK.

 

Pursuant to article 8 of the KVKK, personal data can be transferred without seeking explicit consent, by obtaining the explicit consent of the data subject or in case of one of the situations specified in the article titled 'Processing and Purposes of Personal Data' above. 

 

Pursuant to article 9 of the KVKK, in addition to the above, in order to transfer personal data abroad, there must be sufficient protection in the foreign country where the personal data will be transferred, and the countries where there is sufficient protection will be determined by the Personal Data Protection Board. 

 

vi) Collection Method and Legal Reason of Personal Data

 

Your personal data is collected and processed in all kinds of verbal, written or electronic media and based on different legal reasons as listed above. Your personal data collected with this method and for legal reasons, in accordance with Articles 5 and 6 of the KVKK, in the conditions and conditions specified in the article titled 'Processing of Personal Data and its Purposes', and in particular, Banay Academy fulfills its obligations arising from laws and contracts fully and accurately. It can be processed in line with the purposes specified in this Clarification Text, and it can be transferred to the persons specified under the heading "To Whom and For What Purpose the Processed Personal Data Can Be Transferred".
 

vii) Rights of the Relevant Person

 

Article 11 of the KVKK stipulates certain rights for each natural person whose personal data is processed and regulates the necessity of informing the relevant persons of these rights within the scope of the disclosure obligation imposed on the data controller. 

 

These rights are;

 

  1. learning whether personal data is processed,

 

  1. requesting information on personal data if it has been processed,

 

  1. Learning the purpose of processing personal data and whether they are used in accordance with its purpose, 

 

  1. Knowing the third parties to whom personal data is transferred at home or abroad, 

 

  1. to request correction of personal data in case of incomplete or incorrect processing, 

 

  1. Requesting the deletion or destruction of personal data in the event that the reasons requiring the processing of personal data disappear within the framework of Article 7 of the KVKK, 

 

  1. Requesting notification to third parties to whom personal data has been transferred, that personal data has been corrected if incomplete or incorrectly processed, or that personal data has been deleted or destroyed within the scope of Article 7 of the KVKK,

 

  1. Objecting to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems, 

 

  1. It consists of the right to demand the compensation of the damage in case of loss due to the unlawful processing of personal data.

viii) How Do We Protect Your Personal Data?

 

All necessary technical and administrative measures are taken by us in order to protect the personal data collected and processed by Banay Academy and to prevent it from falling into the hands of unauthorized persons; All necessary precautions are taken by Banay Academy, including, but not limited to, that the software we use in our activities comply with the standards, and the careful selection of the third parties we work with.
 

iv) Right to Apply and Obtain Information

 

Regarding your personal data, if you want to exercise any of your rights explained above under article 11 of the KVKK, you can apply to Banay Academy. This application must be made to Banay Akademi in writing or by other methods determined by the Personal Data Protection Board.

 

Regarding your applications submitted to Banay Academy via the above-mentioned ways, you will be contacted within 30 (thirty) days from the date your application reaches Banay Academy, in accordance with Article 13 of the KVKK. Our answer will be delivered to you in writing or electronically. We would like to mention that; In case our response exceeds ten pages in accordance with the KVKK, a transaction fee of 1 (one) Turkish Lira may be charged for each page exceeding ten pages.
